Don’t Get Bored…Get Brisk® Contest (the “Contest”)
Official Contest Rules (the “Rules”)
  1. SPONSOR/ADMINISTRATOR. The sponsor of this Contest is PepsiCo Canada ULC (the “Contest Sponsor”) and the administrator of this Contest is Elite Email Inc. (the “Administrator”).
  2. ELIGIBILITY. The Contest is open to legal residents of Canada, who have reached the age of thirteen (13) years at the time of entry. The Contest is not open to employees, representatives and agents of the Contest Sponsor, the Administrator, or their respective divisions, subsidiaries, affiliates, franchisees, shareholders, members, officers, directors, representatives, agents, advertising and promotion agencies, Contest suppliers or judges (collectively, the “Contest Parties”), or members of the immediate families (defined as parents, siblings, children and spouses, regardless of where they live) of persons domiciled with (whether related or not), any of the above. Entrants between the ages of 13 and the age of majority in their province/territory of residence will require the permission of their parent or legal guardian to enter the Contest. In the event it is discovered that parental consent was not obtained, the entry will be void. Prizes won by minors will be awarded to the minor’s parent or legal guardian.
  3. CONTEST PERIOD. The Contest will begin at noon Eastern Daylight Time (“EDT”) on May 14, 2018 and will end at noon EDT on September 2, 2018 (the “Contest Period”).
  4. HOW TO ENTER AND NO PURCHASE NECESSARY. Unique Codes (valid for one (1) entry each) will be under the tab of specially marked BRISK® 710mL cans (the “Participating Products”). While supplies last. Not all products and package sizes are available in all areas.

    (i) Text 'BRISK' to 33322 or visit WINWITHBRISK.CA and the Administrator will send you a link;

    (ii) Enter the Unique Code and provide your name, mobile phone number or email address, province, confirmation that you are at least thirteen (13) years of age and that you have read, understood and accept these Rules.

    For each Unique Code correctly entered with the required information, you will receive one (1) entry into the draw. Maximum five (5) with purchase entry per person per day during the Contest Period. All entries must be received by noon EDT September 2, 2018. Subsequent attempts to re-submit or re-use the same Code will be void and ineligible for entry. The Administrator’s computer is the official timekeeping device for this Contest.

    NO PURCHASE NECESSARY. Purchase is not required and does not enhance chance of winning. To obtain one (1) Unique Code, email an original written submission (min 25 words) of what you love about Brisk® Iced Tea, along with providing your name, province/territory, age, and email address (the "No Purchase Request") to brisk@elitedigitalagency.com. Submission must be original in concept and execution, and created by entrant. Within two (2) business days of receipt of a No Purchase Request, the Administrator will email you a Unique Code to use for entering the Contest. Maximum one (1) No Purchase Request per email and one (1) no purchase entry per person per day during the Contest Period. All no purchase entries must be received by noon EDT August 28, 2018.

    All entries become the sole property of the Contest Sponsor and none will be returned for any reason.

    To participate via mobile, you must have a mobile phone with SMS messaging capabilities. You may incur a standard text message charge from your wireless service provider for each message sent and/or received. Check with your wireless service provider for details on these and other applicable charges. Entrants are solely responsible for any such SMS charges or data charges. Not all wireless carriers participate. All entries must be received and recorded within the Contest Period.

    In the event of a dispute over the identity of an entrant, the entry will be considered made by the natural person who is assigned the email address or mobile number by the wireless carrier provider.
  5. PRIZES AND HOW TO WIN.

    INSTANT WIN PRIZES: there are two-thousand one hundred (2100) instant win prizes (each an “Instant Win Prize”) as follows:

    Randomly selected times, during the Contest Period, will be chosen by the Contest Sponsor, and the first entrant to enter a valid Unique Code in accordance with these Official Rules that is properly received and recorded by the Administrator's computer on or immediately after a randomly selected time during the Contest Period will be eligible to win an Instant Win Prize (subject to verification). Odds of winning an Instant Win Prize depend on when the Unique Code is entered. Instant Win Prizes are not transferable and must be accepted as awarded, with no substitutions of any kind, except at the Contest Sponsor’s sole discretion.

    The number of Instant Win Prizes available to be won will diminish throughout the Contest Period as they are awarded. Limit ten (10) Instant Win Prizes per person for the duration of the Contest Period.

    Instant Win Prizes will be delivered between six (6) to eight (8) weeks following verification.

    GRAND PRIZE: There is one (1) grand prize (“Grand Prize”) available to be selected by the winner (approximate retail value of Twenty-Thousand Dollars (CAD $20,000) each) from among the following:

    1. Trip to Tokyo, Japan for a go-kart street racing adventure
    2. Trip to Alabama, USA for a space training adventure
    3. Trip to Queenstown, New Zealand for a canyon swing adventure

    Go Kart Street Racing Details

    • Round-trip economy class air transportation for four (4) people from the major international airport closest to winner’s place of residence in Canada to Tokyo Japan (which may include non-direct flights; airport, carrier and airline ticket class selected at the sole and absolute discretion of the Contest Sponsor);
    • Two (2) standard rooms (double occupancy), for four (4) nights (accommodation to be selected at the sole and absolute discretion of the Contest Sponsor); and
    • Four (4) reservations to go-kart through Tokyo, Japan. (Actual go-kart company to be selected at the sole and absolute discretion of the Contest Sponsor). Winner and guests must have valid driver’s license that is recognized in Japan. WINNER AND GUESTS ARE RESPONSIBLE FOR EACH OBTAINING AN INTERNATIONAL DRIVING PERMIT IN ORDER TO PARTICIPATE IN THE EXPERIENCE.

    Space Training Details
    • Round-trip economy class air transportation for four (4) people from the major international airport closest to winner’s place of residence in Canada to Alabama, USA (which may include non-direct flights; airport, carrier and airline ticket class selected at the sole and absolute discretion of the Contest Sponsor);
    • Two (2) standard rooms (double occupancy), for four (4) nights (accommodation to be selected at the sole and absolute discretion of the Contest Sponsor);
    • Four (4) reservations to Space Training in Alabama, USA which include two (2) night stay as part of the Space Training; and
    • Space Training is based on age group. Winner will attend on selected dates based on age group. Separate training camp for 15 – 18 years and for 18+.

    Canyon Swing Details
    • Round-trip economy class air transportation for four (4) people from the major international airport closest to winner’s place of residence in Canada to Queenstown, New Zealand (which may include non-direct flights; airport, carrier and airline ticket class selected at the sole and absolute discretion of the Contest Sponsor);
    • Two (2) standard rooms (double occupancy), for four (4) nights (accommodation to be selected at the sole and absolute discretion of the Contest Sponsor); and
    • Four (4) reservations to Canyon Swing adventure in Queenstown, New Zealand.

    On September 4, 2018, a random draw will be conducted from among all eligible entries received during the Contest Period to select one (1) entry as eligible to win the Grand Prize. The odds of winning the Grand Prize depend on the number of eligible entrants received throughout the Contest Period.

    If the eligible entrant cannot be located or does not respond within three (3) days of notification, the entrant will be disqualified, forfeits the Grand Prize and the Contest Sponsor may, at its sole and absolute discretion, select another eligible entrant by random draw for the Grand Prize, as applicable. The Contest Sponsor or its representatives will attempt to contact these alternates, who will be subject to disqualification, in the same manner. Allow two (2) to three (3) weeks for verification and confirmation of further details. The Contest Sponsor will not be responsible for failed attempts to notify a selected entrant.

    Grand Prize trip must be selected and fully booked by December 20th 2018. Winner and guests must complete trip no later than September 1st 2019.

    Additional Grand Prize Conditions: Grand Prize Winner may elect to accept the approximate retail value of the Grand Prize in the form of a cheque issued in the name of the Grand Prize Winner, instead of the actual Grand Prize outlined above. Once the winner selects a Grand Prize from above, it must be accepted as awarded and cannot be substituted, transferred, exchanged, except at the sole and absolute discretion of the Contest Sponsor, which may award or substitute a prize of equal or greater value. The difference between the approximate retail value and actual retail value, if any, will not be awarded. The Grand Prize winner and his/her guests are responsible for all other expenses not specifically mentioned herein, including without limitation, ground transportation to and from departure airport, meals, gratuities, taxes, travel documents, telephone calls, in-room movies, mini-bar expenses, room service, medical and travel insurance, excess baggage costs, optional tours, airport departure taxes, duties, all personal expenses and all other expenses not specified herein. Should a minor win the Grand Prize, it will be awarded to his/her parent or legal guardian. The Grand Prize winner’s guests must be legal residents of Canada. Minor guests must be accompanied by a parent or legal guardian. The Grand Prize winner and his/her guests must travel together. Transportation and accommodations subject to availability, standard industry blackout periods, government restrictions and regulations, hotel, airline, airport or other transportation restrictions and regulations. Other restrictions may apply. The Grand Prize winner and his/her guests are responsible for obtaining all required medical and travel related necessities and documentation, including a valid passport, and the right to enter Japan, the United States of America or New Zealand, as applicable. If the Grand Prize winner does not have proper travel documentation, or permission to travel, or does not accept or participate in any portion of the Grand Prize for any reason whatsoever (including reasons beyond the control of the Grand Prize winner such as inclement weather delaying or cancelling a portion of the trip), then that portion of the Grand Prize is forfeited, and the Contest Sponsor shall have no further obligation or liability to the Grand Prize winner with respect to the forfeited portion of the Grand Prize. It is recommended that the Grand Prize winner and his/her guests obtain sufficient personal travel insurance (including emergency medical) prior to departure. The Contest Sponsor is not liable if travel is impeded or refused by reason of decisions of Canadian or other government, airline or airport authorities. The Grand Prize winner and his/her guests (or parent/legal guardian on behalf of a minor winner or guest) must sign and return the Contest Sponsor’s form of Release prior to Grand Prize being awarded. If, for any reason, the selected event does not occur, that portion of the Grand Prize will be forfeited without additional compensation and remainder of the Grand Prize will be awarded in full satisfaction of the Grand Prize award. The Contest Parties shall not be liable for injury, loss, or damage of any kind, resulting from the acceptance, use or misuse of the Grand Prize, travel related thereto or otherwise from participation in the Contest. The Grand Prize winner acknowledges that the Contest Parties have not made or are not in any manner responsible or liable for any warranty, condition, representation, or guarantee, express or implied, in fact or in law, relative to any prize.

    Grand Prize winner and guests must abide by all policies, terms and conditions set out by the selected activity. The Contest Sponsor reserves the right to revoke the full or partial prize from the Grand Prize winner or his/her guests who the Contest Sponsor or venue personnel deem, in their sole discretion, may be intoxicated, be a safety risk, have violated any venue policy or law, or bring the Contest Sponsor into disrepute.
  6. GENERAL CONDITIONS APPLICABLE TO ALL PRIZES.

    IN ORDER TO CLAIM EITHER THE GRAND PRIZE OR A SECONDARY PRIZE, WITHIN THREE (3) BUSINESS DAYS FROM THE DATE OF NOTIFICATION AT THE EMAIL PROVIDED, REGARDLESS OF WHEN IT IS RECEIVED:

    • the potential winner must claim his/her Prize as instructed in the Notification;
    • the potential winner (or parent or legal guardian where applicable) will be required to correctly answer mathematical skill-testing question without assistance of any kind, whether mechanical or otherwise, (the Grand Prize, Drone and Go-Pro Prizes’ skill-testing question will be administered at a time to be mutually agreed upon);
    • the potential winner (or parent or legal guardian where applicable) must accept the terms of a Declaration of Compliance and Release, which confirms compliance with these Rules and releases the Contest Sponsor and the Contest Parties from all liability with respect to the entrant’s participation in this Contest and the awarding, use and misuse of any Prize; and
    • the potential winner (or parent/legal guardian where applicable) may be required to furnish proof of identification that may include a driver’s license or other form of picture identification as part of the verification process.


    Any Prize must be accepted as awarded, cannot be substituted, transferred, exchanged or surrendered for cash, except at the sole and absolute discretion of the Contest Sponsor, which reserves the right, at its sole and absolute discretion and for any reason, to award a substitute prize of equal or greater value, including a cash award. Awarding of a Prize is subject to verification and compliance with the Rules. Entrants who have not complied with the Rules will be disqualified. Gift cards are subject to terms and conditions imposed by the issuer. The Contest Sponsor makes no representations or warranties of any kind concerning the appearance, safety or performance of any Prize. Any unclaimed Prize will not be awarded.
  7. ADDITIONAL CONDITIONS OF PARTICIPATION. By participating in this Contest, entrant accepts and agrees to these Rules and all decisions of the Contest judges (who may be employees, agents or independent contractors of the Contest Sponsor), which shall be final and legally binding on entrant in all matters relating to this Contest. All entries become the property of the Contest Sponsor and will not be returned. In order to be confirmed a winner and receive any Prize, the selected entrant will be required to sign the Contest Sponsor’s Declaration of Compliance and Release form which confirms compliance with these Rules and releases the Contest Sponsor, Administrator and their respective affiliated companies, agencies, Contest Prize suppliers and their respective officers, directors, employees and agents from all liability with respect to the entrant’s participation in this Contest and the awarding, use/misuse of the Prize. The winner agrees to the use of his/her name, image, likeness, persona, and city/province of residence for publicity purposes, and grants to the Contest Sponsor and participating cafeteria locations, any and all rights to said use without further notice or compensation. The Contest Sponsor and its respective affiliates are not responsible for printing, technical errors, distribution, or production errors. The Contest Parties do not warrant that access to or use of the Contest will be uninterrupted or error-free.

    Entrants and/or winners assume liability for injuries caused, or claimed to be caused by participating in the Contest, by the acceptance, possession, use or misuse of any Prize awarded, including but not limited to claims/damages for personal injury, or property damage. Moreover, as a condition of entering, entrants (or their parent or legal guardian if entrant is a minor) agree: (a) to release the Contest Sponsor and Contest Parties, and each of their officers, directors, employees and agents, from any and all liability, loss or damage incurred with respect to participating in the Contest or the awarding, receipt, possession, and/or use or misuse of any Prize , (b) that under no circumstances will entrant be permitted to obtain awards for punitive, incidental, consequential, or any other damages and entrant hereby waives all rights to claim for all such damages; (c) all causes of action arising out of or connected with this Contest, or any Prize awarded, shall be resolved individually, without resort to any form of class action; and (d) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, excluding legal fees and court costs. This exclusion or limitation of liability will not apply to the extent that any applicable statue prohibits such exclusion or limitation of liability.
  8. LIMITATION OF LIABILITY. By entering this Contest, the winner acknowledges and agrees that the Contest Parties (i) shall have no liability of any kind whatsoever with respect to this Contest and/or the awarding, use or misuse of any Prize, (ii) make no warranty, guaranty or representation of any kind concerning any Prize, (iii) disclaim any implied warranty, and (iv) are not liable for injury, loss or damage of any kind resulting from the entrant’s acceptance, use or misuse of any Prize or otherwise from such entrant’s participation in this Contest. The Contest Parties are not responsible for typographical or other errors in the offer or administration of this Contest, including but not limited to errors in advertising, the Rules, the selection and announcement of winners, or the distribution of the Prizes.
  9. INDEMNIFICATION. By submitting an entry, entrant agrees to indemnify and hold harmless the Contest Parties from and against any and all claims, losses, costs, damages, liabilities and costs and expenses (including reasonable legal fees) which may arise out of any breach of any of covenants, agreements, terms, obligations, representations or warranties set forth herein.
  10. RIGHT TO TERMINATE, MODIFY OR SUSPEND. The Contest Sponsor may at any time, at its sole discretion and without liability, terminate, modify or suspend the Contest in whole or in part, subject only to approvals required by law, if fraud, technical failures or communications or any other errors or other causes beyond the control of the Contest Sponsor corrupt the administration, integrity or security of the Contest or if any other factor interferes with the conduct of this Contest as contemplated by these Rules. Without restricting the generality of the foregoing, in the event of early termination of the Contest, a notice will be posted at WINWITHBRISK.CA. In addition, for the purposes of determining eligibility to win a Prize in the event of early termination of the Contest, all eligible entries received prior to the time of early termination will be considered as valid and for the purposes of these Rules, the Contest Period will be deemed to have ended at the moment of early termination. The Contest Sponsor reserves the right, at any time, in its sole discretion, to correct any errors, including without limitation, any typographical, printing, computer programming or operator errors. The invalidity or unenforceability of any provision of these Rules shall not affect the validity or enforceability of any other provision. If any provision of these Rules is found to be invalid or unenforceable under applicable law, then it shall be, to the extent invalid or unenforceable, deemed omitted and the remaining provisions will continue in full force and effect. No waiver on the part of the Contest Sponsor to enforce of any term herein shall be deemed a continuing waiver or a waiver of any other term.
  11. QUEBEC RESIDENTS ONLY: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement. Any applicable decision to be made by the Contest Sponsor affecting the conduct of this Contest are subject to a ruling of the Régie des alcools, des courses et des jeux.
  12. GOVERNING LAW: EXCEPT FOR RESIDENTS OF THE PROVINCE OF QUEBEC, all issues and questions concerning the construction, validity, interpretation and enforceability of these Rules, or the rights and obligations of entrant and the Contest Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the substantive laws of the Province of Ontario without regard to conflicts of law principles. All entrants consent to the jurisdiction and venue of the Province of Ontario.
  13. DISCREPANCY: This Contest is subject to all applicable, federal, provincial and municipal laws. In the event of any discrepancy or inconsistency between the terms and conditions of these English language Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to: the Release, and/or point of sale, print or online advertising; the terms and conditions of these English language Rules shall prevail, govern and control.
  14. PERSONAL INFORMATION. Unless you specifically select otherwise, the personal information gathered about entrants in the course of this Contest will be used solely by the Contest Sponsor or its designated agent for the administration of the Contest and in connection with any publicity relating to the Contest.
